Ludwig Kaiser’s attempt to get a misdemeanor battery charge dismissed was denied on Monday, per online court records.

Kaiser, real name Marcel Barthel, remains in a legal battle in connection with an incident on April 23 in which he is alleged to have punched a man multiple times inside an elevator in Orlando, Florida.

An affidavit says that Richard Reap, the man who they named as the one subject to the alleged assault, was attacked after telling a couple acting in an “uncontrollably intimate” way to “please have some manners.”

Barthel filed a motion to dismiss back in July based on Statutory Immunity under Florida’s Stand Your Ground law. In the filing submitted by Barthel, he claimed that Reap had “made loud comments” at him and partner Andrea Bazarte after seeing them hugging, including “Have some fucking respect.” It was claimed at one point that Reap threatened to call ICE on Bazarte, who is of Mexican descent.

Barthel also claimed that Reap had come toward him “aggressively raising his hands and getting very close to him.” Barthel said he pushed Reap away many times, noting that he was advancing towards him in a “threatening manner.” It was claimed that he used non-threatening force, thus defensible by law.

Judge Andrew L. Cameron shot down this attempt to dismiss on Monday, records show.

The Orange County Clerk of Courts database is now listing that a pre-trial conference will take place on December 17.

Barthel is mainly a member of WWE’s AAA roster at the moment, portraying the masked persona El Grande Americano. He has remained on TV amid his ongoing battery case, currently holding AAA’s top title, the Mega Championship.
